OverGame Terms of Service

Effective date: 6 December 2025

1. Acceptance of the Terms

By using OverGame (the "Service", the "App"), you accept these Terms of Service (the "Terms"). If you do not accept these Terms, do not use the App.

2. Description of the Service

OverGame is a mobile application for managing sports teams that lets you:

• Create and manage teams
• Organise sports events
• Manage group payments
• Track fines and medical certificates
• Communicate with team members

3. User Accounts

3.1 Registration

• You must provide accurate and complete information
• You must be at least 14 years old
• You are responsible for the security of your account
• Do not share your credentials

3.2 Account Responsibility

You are responsible for all activity that takes place through your account.

4. Acceptable Use

4.1 You may:

• Use the App for personal, non-commercial purposes
• Create and manage your teams
• Invite other users to your teams

4.2 You may NOT:

• Break laws or regulations
• Harass, abuse or harm other users
• Upload offensive, illegal or inappropriate content
• Attempt to breach the App's security
• Use bots or automated systems
• Impersonate other people or entities
• Sell or transfer your account

5. User Content

5.1 Ownership

You keep all rights to the content you upload (photos, documents, messages).

5.2 Licence

You grant us a limited licence to host and display your content in order to provide the Service.

5.3 Responsibility

You are responsible for the content you upload and warrant that you have the necessary rights to it.

6. Payments

6.1 Payment Features

The App lets you track payments between team members. We do NOT process payments directly.

6.2 Responsibility

OverGame is not responsible for:

• Financial transactions between users
• Payment disputes
• Fraud or errors in tracked payments

6.3 Premium Subscriptions

Some team features (unlimited events and members) require a Premium subscription, monthly or yearly, purchased through Apple's App Store or Google Play.

• The price is shown in the App before purchase, and the amount is charged to your App Store or Google Play account when you confirm
• The subscription renews automatically for the same period and at the same price unless cancelled at least 24 hours before the end of the current period
• You can manage or cancel the subscription from your App Store or Google Play account settings. Cancellation takes effect at the end of the period already paid for
• Refunds and the right of withdrawal are handled by Apple or Google under their own terms
• The subscription is tied to the team it was purchased for. Deleting your account does not cancel the subscription on the store

7. Intellectual Property

7.1 Our Rights

All content in the App (design, code, logo, text) is owned by OverGame or its licensors.

7.2 Trademarks

"OverGame" and its logo are trademarks of Andrea De Piccoli. You may not use them without permission.

8. Privacy

Our use of your data is governed by our Privacy Policy, which forms part of these Terms.

9. Changes and Interruptions

9.1 Changes to the Service

We may change, suspend or discontinue the Service at any time.

9.2 Changes to the Terms

We may update these Terms. We will inform you of significant changes.

10. Termination

10.1 By You

You can delete your account at any time in the App (Profile → Options → Delete account) or by following the instructions on the Account deletion page.

10.2 By Us

We may suspend or terminate your account:

• If you breach these Terms
• For legal or security reasons
• In case of prolonged inactivity

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE THAT:

• The Service will be uninterrupted or error-free
• The results will be accurate or reliable
• Defects will be corrected

12. Limitation of Liability

TO THE EXTENT PERMITTED BY LAW, OVERGAME IS NOT LIABLE FOR:

• Indirect, incidental or consequential damages
• Loss of profits, data or opportunities
• Damages arising from the use of, or inability to use, the Service

13. Indemnification

You agree to indemnify and hold OverGame harmless from any claim arising from:

• Your use of the Service
• Your breach of these Terms
• Your infringement of third-party rights

14. Dispute Resolution

14.1 Governing Law

These Terms are governed by Italian law. If you are a consumer living in another European Union country, this choice does not deprive you of the protection of the mandatory laws of the country where you live.

14.2 Jurisdiction

If you are a consumer, any dispute falls under the jurisdiction of the courts of the place where you live or are domiciled (Art. 66-bis of the Italian Consumer Code, Legislative Decree 206/2005; for consumers living in another EU Member State, Art. 18 of Regulation (EU) 1215/2012). If you use the Service for professional purposes, the courts of Treviso, Italy have exclusive jurisdiction.

15. General Provisions

15.1 Entire Agreement

These Terms constitute the entire agreement between you and OverGame.

15.2 Waiver

Failure to exercise a right does not constitute a waiver of that right.

15.3 Severability

If any provision is invalid, the remaining provisions stay in effect.

15.4 Language

These Terms are available in Italian and English. In case of any discrepancy between the two versions, the Italian version prevails, to the extent permitted by applicable law.
